'CHEZ PEPE MERLE' GUESTHOUSE<\/strong><\/p>\n

Article 1. Preamble<\/span><\/p>\n

CLAIRE BERNI HOSPITALITY PARIS, a limited liability company operating under the trade name \n\u201cCHEZ PEPE MERLE\u201d, whose registered office is located at 131 rue du Chemin Vert, 75011 Paris, \nFrance, registered with the Paris Trade and Companies Register (RCS Paris) under SIRET number \n104 854 385 00010, carries out the business activity of operating guest houses located at 131 rue \ndu Chemin Vert, 75011 Paris, France. \nCHEZ PEPE MERLE offers and provides accommodation and hospitality services, as detailed on its \nwebsite available at www.chezpepemerle.fr<\/p>\n

Article 2. Subject matter and scope<\/span><\/p>\n

These terms and conditions define the rights and obligations of CHEZ PEPE MERLE and those of \nthe Customer. \nThey apply to all bookings made via the website www.chezpepemerle.fr, by email or by phone. \nThey do not apply to bookings made directly between partners of CHEZ PEPE MERLE and the \nCustomer. \nThe Terms and Conditions can be consulted simply, freely and at any time on the website \nwww.chezpepemerle.fr and \/ or requested by emailing bienvenue@chezpepemerle.fr. In any \ncase, the Terms and Conditions are systematically sent to the Customer to enable him to make \na reservation. \nAny reservation implies irrevocable and unreserved acceptance of the Terms and Conditions, \nwhich prevail over any other document or information issued by CHEZ PEPE MERLE, with the \nexception of specific conditions which have been expressly agreed in advance by CHEZ PEPE \nMERLE.<\/p>\n

Article 3. Booking<\/span><\/p>\n

3.1 - Services
The Customer chooses the provision of Services presented on the Site. \nCustomers confirm that they are aware of the nature, purpose and methods of booking the \nservices available on the Website or Mobile Services and have requested and obtained the \nnecessary and\/or supplementary information needed to make the reservation in full knowledge \nof the facts.<\/p>\n

3.2. Booking process
The reservation made by the Customer is made through the website or directly by email or \ntelephone. \nPrior to any reservation being confirmed, the Customer agrees to complete the information \nrequired in the booking request form. Customers attest to the truth and accuracy of the \ninformation submitted. \nThe booking is deemed to have been made when payment is effected online by credit or debit \ncard.<\/p>\n

3.3. Booking confirmation
CHEZ PEPE MERLE will send the Customer booking confirmation by email including a summary of \nthe reservation and in particular, the prices, the Terms and Conditions accepted by the \nCustomer, the date of reservation made and the terms of payment for the reservation.<\/p>\n

Article 4. Conditions governing cancellation or modification<\/span><\/p>\n

For all practical purposes, the Customer is informed that the right of withdrawal applicable to \ncontracts concluded at a distance cannot be exercised with regard to the provision of \naccommodation services other than residential accommodation.<\/p>\n

4.1. Cancellation
Any cancellation of the reservation by the Customer or CHEZ PEPE MERLE must be notified by \nemail to the following email address: bienvenue@chezpepemerle.fr. \nIn the event of cancellation by the Customer before the arrival date indicated on the booking, \nthe sums paid will remain in the possession of CHEZ PEPE MERLE.<\/p>\n

\u2022 Up to 8 days before the scheduled date of arrival: full refund of sums paid by the customer \nless bank fees for return of funds.
\u2022 3 to 7 days before the scheduled date of arrival: 50% of the sums paid by the customer
\u2022 48 hours before the scheduled arrival date: no refund of sums paid by the customer<\/p>\n

In the event of the customer failing to arrive and giving no notice within the 24 hours prior to \nthe arrival date agreed on in the booking : all sums paid by the Client remain in the possession \nof CHEZ PEPE MERLE.\n\nExcept in cases of force majeure, cancellation by CHEZ PEPE MERLE before the arrival date \nindicated on the booking entails reimbursement to the Customer of the sums already paid.<\/p>\n

4.2. Interruption
In the event that the Customer does not stay for the entirety of their booking, the full price of \nthe service remains entirely due to CHEZ PEPE MERLE.<\/p>\n

Article 5. Financial Conditions<\/span><\/p>\n

5.1 Prices
Prices are in EUR and include all taxes (TTC). The amount debited to the Customer will be \ndifferent from that invoiced by CHEZ PEPE MERLE if the currency of his account is not the euro. \nThe amount may vary depending on differences between exchange rates. This differential cannot \nbe reimbursed. In addition, the Customer may be charged a commission by his bank pertaining \nto the carrying out o a transaction in euros. These costs will remain the responsibility of the \nCustomer.<\/p>\n

5.2. Method of payment and invoicing
The amounts of the cost of the booking and the tourist tax (included in the taxes) are indicated \nbefore and during the reservation process and stated in the booking confirmation. \nAny reservation request must be paid in full upon reservation. This payment is made by credit or \ndebit card.<\/p>\n

Article 6. The stay itself<\/span><\/p>\n

6.1. Duration and timings
The stay begins and ends on the dates and times indicated on the reservation. Check-in is \nbetween 5 p.m. and 7 p.m. Check-out is before 11:00 a.m. Any deviation from arrival and \ndeparture times must be determined in agreement with CHEZ PEPE MERLE and may give rise to \nadditional costs. The Customer will inform CHEZ PEPE MERLE of the arrival time one week before \narrival. \nThe Customer may not under any circumstances invoke any right to remain in the premises at \nthe end of the reservation period, except with the agreement of CHEZ PEPE MERLE and with or \nwithout a pro rata temporis increase in the price of the booking.<\/p>\n

6.2. State of the accommodation
CHEZ PEPE MERLE provides the accommodation as described on its website and maintains it in \nappropriate serviceable order. \nThe Customer is required to occupy the premises with due diligence and in keeping with the use \nfor which they are intended.Upon departure, the Customer undertakes to leave the \naccommodation in a reasonable state of cleanliness. The booking cost includes the cost of end\nof-stay cleaning. However, if any damage is found, additional cleaning costs will be charged.<\/p>\n

6.3. House regulations
The rooms are intended for temporary or holiday use excluding professional, commercial or trade \nusage of any kind. \nThe apartment is furnished and decorated with items that the guest can make use of during their \nstay. Everyone is therefore asked to make reasonable and respectful use of the premises. \nIt is strictly forbidden to smoke, both inside the rooms and in the common areas of the building. \nPets are not allowed. Anybody whose presence was not declared at the time of booking is \nprohibited from entering the Chez P\u00e9p\u00e9 Merle building and apartment. \nIn the interest of everyone's rest and relaxation, all noise must cease from 10 p.m. until 7 a.m. \nParties are prohibited. \nIn order to respect the environment, we count on our guests to be responsible and mindful of \ntheir consumption of water and electricity, and their use of the towels provided. \nWIFI is free but we remind you that downloading is illegal.<\/p>\n

Article 7. Liabilities<\/span><\/p>\n

CHEZ PEPE MERLE declines all liability in the event of theft, loss or damage to the Customer's \npersonal objects and effects, those of his family and more generally those accompanying him. \nThe Customer is responsible for any damage caused by himself, his family and more generally \nthe people who accompany him. He is required to have civil liability insurance, or failing that to \nbe coverered by an extension of guarantee or a specific contract.<\/p>\n

Article 8. Protection of personal data<\/span><\/p>\n

In accordance with law n\u00b0 78-17 relating to data processing, files and freedoms of January 6th, \n1978, personal data relating to Customers may be subject to automated processing. CHEZ PEPE \nMERLE reserves the right to collect information on Customers including via the use of cookies. \nCustomers can oppose the disclosure of their data or exercise their right of access, rectification \nand withdrawal of this data, under the conditions provided for by law n\u00b0 78-17 relating to data \nprocessing, files and freedoms of January 6th, 1978, and in particular oppose the storage of \ncookies, by sending their requests to Chez P\u00e9p\u00e9 Merle by email to bienvenue@chezpepemerle.fr \nor by post to CHEZ PEPE MERLE, 131 Rue du Chemin Vert, 75011 Paris, France.<\/p>\n

Article 9. Applicable Law \/ Dispute Resolution<\/span><\/p>\n

These terms and conditions are subject to French law. Any complaint or dispute relating to the \ninterpretation, execution or termination of these Terms and Conditions must be the subject of \nan attempt to settle amicably. In the event of a persistent disagreement, the dispute will be \nsubmitted to the jurisdiction of the competent French courts.<\/p>\n
